First Time Home Buyer Tax Credit

There has been a lot of talk (and confusion) about the economic stimulus bill and what it means to home buyers. Who qualifies? What year can I claim the credit? How much of a refund would I get back? What are the criteria to receive the credit? So I'm going to attempt to answer the most common questions about the bill. Keep in mind, I am NOT a tax professional or accountant and always recommend when it comes to your taxes to seek the advice of an accredited tax professional.

That being said, the bill states that first time home buyers can claim a tax credit worth $8,000 OR 10% of the home's value, whichever amount is less. So, if you bought a condominium for $65,000, your tax credit under the bill would be $6,500, not $8,000.

Qualifying

In order to qualify for the credit, the home purchase must be made between January 1st and November 30th of 2009 (so if you buy a home on December 1, 2009 you are not eligible). In addition, there are income restrictions as well. To qualify, a single person must make less than $75,000 a year. Married couples must make under $150,000 a year. However, higher income buyers may receive a partial credit. You must also live in the house purchased for at least three years or you will be required to pay back the credit. The property being purchased can not be owned by a close relative like a parent, grandparent or one of your children. The definition in bill for a first time home buyer is anyone that has not owned a home in the last three years.

Tax Filing

The credit can be claimed on your 2008 or 2009 income taxes. Now as I said you can claim the credit on your 2008 tax filing. If you have already filed them, you can file an amended return to claim the credit if you wish to do so. Based on the feeback we've been getting, the process takes about 12 weeks. Another great thing about the credit it that it is fully refundable, so even if your total tax bill (refund) is less than $8,000 (and you qualify for that amount of a credit), you would still receive the full $8,000 back plus the amount you had overpaid.

For example, John's taxes showed that he had paid $5,000 in taxes over the year. He filed his return and he actually only owed $3,000 in taxes. Normally he would have received a refund of $2,000. But under this bill, he would receive the full $10,000 instead! To claim the credit on your taxes is just a matter of filling out the form, without any additional paperwork involved.

I got my check today!!

I got my check in the mail today with $79 interest! Whew.

I mailed my stuff off July 30. Called several times to check on it. First week of September I called to check and they said something was being sent out on Sept 7 (nothing came).

Called back last week and there was a message telling me to dial a different number if I had filed by July 30. I called the number and they said my check was being mailed on Sept 18.

CHECK ARRIVED TODAY along with a letter telling me the check was coming... So happy. Good luck to all of you!!

Still waiting

I was told from the IRS that my check was sent off Sept 4th, 2009 from the Atlanta office and I live in Atlanta, still no check. I hope that it is on its way. I did get a letter on the 12 that was dated Sept 7th, stating my refund amount and if I have not recieved yet give it about two weeks. So now we are 2weeks and three days! Ihope its on its way. I never heard of a mail taking that long within the same city. I will keep the faith on this one!

To check on the status of your 1040X and 5405 (for the $8K FTHTC) the IRS phone number is:

1-800-829-0582 * Press 1 for English* then the Extension number is: 462

Keep a paper trail by writing down the IRS agent's name and their ID number, just in case your need to contact a tax advocate. When you call, good luck on getting an agent that is actually "helpful". I have hung up on agents that sound angry when they answer the phone, while giving their name and ID number. I just call right back to get a more pleasant person to talk to. LOL!! The IRS agents that you talk to on the phone ARE NOT the ones who are processing your paperwork. THANK GOD! The processors, who actually work the returns are in an entirely different area, and don't answer incoming calls. The processors will update the IRS system when something is done with the 1040X and 5405. Well, anyway make sure that you verify the date that your return was received, because the clock starts ticking on that date. The IRS also has to pay you interest. So, you will not only receive the $8K, but it will also include the interest accrued for the wait.

FILED MY AMENDED RETURN ON MAY 12TH. IRS RECEIVED MAY 14TH. ON AUGUST 6 SENT TO REVIEW. RECEIVED LETTER DATED AUG 14TH ON THE 24TH REQUESTING ADDITIONAL INFORMATION. FAXED IT BACK NEXT DAY BUT RECEIVED IN SYSTEM ON AUG 27TH. TODAY SEP 21 I RECEIVED A LETTER WITH THE SAME DATE STATING THAT MY INFORMATION HAS BEEN RECEIVED AND IS BEING REVIEWED. i SURELY DONT UNDERSTAND HOW CAN I RECEIVE A LETTER FROM ATL DATED FOR THE 21 OF SEPT ON THE 21 OF SEPT. WHAT KIND OF BUTTER STACKS IS THIS. C'MON WE ALL KNOW THE IRS IS SLOOOOOW! Since I've been following this blog for a couple months I thought I'd post today's news. I had an accountant amend my taxes (didn't want to screw it up) and sent it in to the IRS in the middle of June. I live in Maine and I sent it to Andover, MA. I just received my check today $8125.04 (four cents..really?) and its September 21st. So that's about 13 weeks.

I was so excited because my congressman was going to help me. So I thought. They sent me a privacy disclosure so they could contact the irs on my behalf. I just received a message from his office telling me I would just have to be patient that I had been picked for audit and that they would contact me for more info.OMG!!!!!! No joke I was picked for audit I told them that when I contacted them. I am passsed patient after 17 weeks and there is no one to help. I am at their mercy. Could someone please tell me what recourse you took when your 16 weeks was up and you still can't get answers. My congressman is a waste of time.

Sheriff Deed or Foreclosed Home

I am looking at purchasing a foreclosed home from the bank I work for. This will be the first home I have bought. Do foreclosed or Sheriff Deed homes qualify for the tax credit?

how is it they sent the check to our last years address after we had signed the change of address forms and everything else? The good news it they recieved it back so we don't have to wait and see... the bad news is they can't send us another check for atleast 4 weeks!!! What I don't understand is why does it take so long to print a new check? I hate not knowing what's going on . Has this happened before to anyone?

I guess we were one of the lucky one's and didnt have to wait.

My husband and I bought our

My husband and I bought our first home and close on June 18th. I didn't realize that we could amend our return to claim the credit until the end of July. I mail the 1040x and the 5405 on July 27th. After finding this forum, I called the magic number and called in about the end of August and was told that my forms were received August 24th. I have no idea why it took almost a month to be received (I mailed from PA to Kansas City) I've been calling once a week since just because I have never learned patience and the stories on here have me terrified something is going to go crazy wrong. At my last call (last monday) it was in processing. We got a ridiculously good deal on our home because it was a foreclosure (paid 45000 for a 168000 appraised home), so we're only claiming $4500 of course. I'm nervous now because no one has mentioned anything about buying foreclosures on here. We went through the same process as a normal purchase (with a few more hoops to jump through) and still have a standard 30 year mortgage. Has anyone on here bought a foreclosure and successfully claimed the credit?
BTW- if you call before 8am, you have no wait time.

We closed June 10th. Sent the HUD with the 1040, it was NOT an amended return. We used a tax preparer and e-filed. Return was recieved June 28th. Sent to Examination. We recieved a letter Aug. 31st requesting the HUD and saying it appeared we had owned a home in the last three years. Faxed in the HUD, Tax Stamp and proof we had not owned a home, (lease with landlord info). We were told we have to wait thirty days for it to process, then, it may be approved or disapproved, then, we can ask for an appeal.

That's where I sent mine. I did not send my HUD papers with my original return, but from what the exams office told me, it doesnt matter. They wont get them. I hope you have better luck than me. I have been waitng over 6 months.

To answer your questions...

in my case after waiting for 19+ weeks my file was never send to an audit/review process. I was just being told that as new files were coming in from others claiming the credit that with my particular worker she would stack the new cases on top of the old ones and then work her way from the top down.

Bull Hockey, if you ask me. You should work on them in the order they are received. Outrageous for someone to get their check in 4 weeks while mine has been sitting there for months.

They extra $130.19 in my refund is interest. Which the IRS informed me is counted as taxable income on your income tax return next year. I am not sure how they figure out the interest because even people who have gotten their refund in 4 weeks have got the same amount of interest as me and I have been waiting much, much longer.

I would hope they don't extend the credit into next year. If they are this slow about doing the credits and it really isn't even tax season right now. What happens when they extend the credit into next year? Will everyone who is waiting for their normal refunds have to wait 20+ weeks? I don't see them hiring extra people to take care of this mess!

Ammended Return

I filed mt ammended return the last week in April. I called IRS several times...maam its processing it will take 8 weeks. So I call after 8 weeks...maam we changed to 12 weeks.
So I call at 12 weeks...maam it could take up to 16 weeks we changed our deadline. Ok so I call at 16 weeks.... well maam your return was sent to audit. I got a letter about 3 weeks later stating they need more paper work. Sent the paperwork rhe next day and still no money. It is going on 23 weeks now and this is slap crazy.

Update after 27 weeks of waiting

Just wanted to update on my situation. I have been waiting for 26 weeks for my refund and as of today, September 18, I received a notice from the IRS stating that my refund was allowed and that I would be receiving my check shortly. My amended return was in examination for approximately 32 days before I received this notice. So, to all of you waiting there is hope! I will update again when I actually receive the check.

You do realize that "shortly" means 6 to 8 weeks! Oh, I despise these people! But, you're one step closer, I guess.

Did you get the first letter telling you it was in review? How long was it from that letter if you received it until you go the approval letter?

I was told this morning that my check would be mailed on October 2. So, from examination to check in my case took about 2 full months! I hope this helps all of ya! From start to finish I will have been waiting a total of 30 weeks.

I did get a letter stating that I needed to send in additional paperwork about 30 days after it first went into review/examination. That letter was received on August 6, I immediately faxed the information to them and they said it was received on August 14. So, in my case it took about 32 days from the day they say they received my additional paperwork until I received my letter saying the claim was allowed.

I closed on my home on August 13th. I had my form filled out by my tax lady and I mailed my amended return form 1040X and Form 5405 (or whatever it was) via Fed EX (cost around $15) standard overnight to the IRS Office Building in Austin, TX (being from TN that's where it had to go), instead of sending it to just IRS, Austin, TX. They received it the next day, August 20th. I was told by my tax lady to be patient, most returns like this could take up to 12 weeks and to not call until my return had been received by their office at least 4 weeks. So, practicing a virtue I am not well know for, I waited patiently, and when 4 weeks was up, I called. It was Friday, September 18th. Here's how the conversation went: Dialed the IRS number given in someone's previous blog 1-800-
Pressed 1 for English (Don't I live in America?)
Then entered the extension:

IRS: THANK YOU FOR CALLING THE INTERNAL REVENUE SERVICE, THIS IS MRS. MCKINNEY, ID NUMBER BLAH BLAH BLAH (SHE TALKED SO FAST I DIDN'T CATCH THE NUMBER) HOW MAY I ASSIST YOU

ME: HI. I AM CALLING TO CHECK THE STATUS OF MY AMENDED RETURN IN ORDER TO CLAIM THE FIRST TIME HOME BUYERS CREDIT.

IRS: WHAT DATE DID YOU MAIL YOUR RETURN

ME: AUGUST 19 FED EX OVERNIGHT

IRS: OK, IT STILL MAY BE TOO EARLY TO TELL BUT LET ME CHECK (SHE THEN ASKED FOR MY SS#)

WHEN SHE RETURNED ON THE LINE SHE STATED THAT MY RETURN HAD BEEN RECEIVED. I ASKED HER IF THERE WAS A PROJECTED PAYMENT DATE AND SHE SAID THE 18TH. WAIT, HOLD THE PHONE, DID YOU SAY THE 18TH???? THAT'S TODAY. SHE SAID, YES IT IS. YOU SHOULD HAVE YOUR CHECK BY THE 21ST, WHICH IS MONDAY. IF YOU HAVE NOT RECEIVED IT BY THE 30TH THEN PLEASE CONTACT OUR OFFICE AND REPORT IT.

OMG...So I waited a total of 4 weeks before calling and I am now told to wait just a few more days and I will have my $8,000 plus interest in the amount of $122 (still not sure how they are basing that but hey, i'm not complaining). I am hoping to see that check any day now and once I do I will post and verify how long it actually took for it to make it from Austin,TX to my mailbox in Oakland, TN.

This Gov is full of Crap!

Ok so I closed on my house on July 24th. I had H&R Block prepare my amended return and I mailed it in on Aug. 2nd. Today, (9/17/09) I checked the mail and got excited when I had an enevlope from the IRS. My excitement quickly changed to disappointment when I realized how thick the letter was. It couldn't possibly have a check in it. I opened it and of course no check. Instead it was another enevlope with a letter stating they needed more information. So I called the number given on the letter. Held for 17 min. to talk to someone that was very rude and kept cutting me off as I was tryig to explian the letter and my situation. She kept asking if I mailed in my closing contract. (I mailed in a copy of the entire packet sent to me from my closing lawyer.) I told her that was all included and she stated that they hadn't recieved anything. Well if that was the case how did they know to mail me the letter and that I had amended my return???? I really don't understand. I am 26 years old and I finally own my first home. I can't make any changes to it because I haven't gotten my money. Anyway, She told me that I needed to just disreguard the letter that it was probably sent in error. OK?! But what if I resend in my papers am I going to have to start the waiting game all over again? Will someone please tell me what I should do???? PLEASE.

IRS TREASURY DEPT. Letter

If your letter was from the IRS Treasury Dept. they probably are asking for your HUD1 form. This is the document you got at your closing. If this is the case (read your letter carefully) FAX the HUD1 form to the listed Fax number. DON'T send it by mail!!!! All the mail the IRS/Treasury get is inspected(Terrorism) and your mail item may take 30 days to go from the mail floor to the audit floor. Just relaying what I was told. Hope this helps in some way. We have been waiting since early June.
And they think they can run the Health Care System!!!! Think about that? LOL.

We closed on the house april 27th. Sent out the amended 1040 but our tax preparer didn't give us the page to request for the credit.Irs sent a large envelope with the 1040X and a note saying we needed to send back the other form june 13th. After noticing that the check marks and verification marks proving that we are who we say we are (a plus... i think) sent it ALL back june 16th. called the tail end of july and got to talk to a very snitty person who was less than helpful to say the least.

called again the tail end of august and was informed to call back in october. On a lark called tonight (sept 17th which is 12 weeks from the resend) and was told that our claim is being "re-adjusted" and is in processing and to call back in 4 weeks.

has anyone else been told they were readjusted and exactly what the heck does that mean?

Just called the magic number. The lady told me they received our amended return on 7/6, and that's the only info she can give me. She suggested that I should call back a month later.... urgh... I have been waiting for 10 weeks+....

Check Received (Thank You!!!)

I have been reading this board every since I closed on my house 7/21/09. I was dreading the 12-16 week wait as I spent all my funds just to get my house move-in -ready. It needed a lot of additional work.
I sent my paperwork off the very same day (7/21/09) and I mailed only the two IRS forms in (1040X and 5405). I received my check 9/15/09 with $122 in interest. Only waited about 6-7 weeks total. I mailed to the Atlanta office per the instructions on the form for my area. I am happy that it did not take as long as some of the horrible stories I have been reading on this site but I continue to pray for all who are trying to get their checks from the IRS.

Does my brother in law qualify as a 1st time homebuyer if.......

My inlaws are buying a home in Georgia. They do not qualify for the tax credit because they own a home in New York. My brother-in-law is going to be moving in with them to help them with bills but has never owned a home. What do we need to do in order to assure that he (my brother-in-law) can qualify for the tax credit?

Talked with the IRS

I called the number that someone posted.... 800-829-0582 ext. 462, to check on the status of my amended return for the home buyers credit. I told the lady that I was not calling to complain, but that I had heard several people say that their paperwork was never received and I needed to verify that they received mine.
I purchased my home in June, but didn't file the paperwork until the end of August. The lady I spoke to was very nice and she said it had been received and approved for the amount of 6K and that processing would take a few weeks. She said her best estimate is that I'd receive my check by the end of October.
I guess now I just play the waiting game......

Amended Returns

I have done taxes for 15 years, I am also an EA (enrolled agent) which for those that don't know what that is, it is 2 days worth of testing thru the IRS. Any return I sign has that designation. My son purchased a home this year, his check was back in 5 weeks, which is extremely quick for an amended return.

For the one's of you still waiting that filed your amended tax returns during the normal tax filing period, your tax pro, CPA or whoever should have told you to hold your amended until your tax return had totally been processed. Just because you may have a check, does not mean it's processed, and if the amended gets in first....not a good thing. Over 7% of the first time home buyers returns have been fraud, the IRS was forced to put in new controls to check to make sure only the persons entitled to it received it, that has added to the delay.

Regardless of the reason for the amended return, my clients are always advised that it will be 12 to 16 weeks to be processed, that's just the norm.

There are many things they are checking for, whether you've claimed any mortgage interest in the last 3 years, or your spouse. Even if you haven't lived with your spouse in umpteen years, but are legally married, if they own a house or have in the last 3 years, you don't qualify. Maybe not be right, but it's how the bill was written, these are all things that are being checked.

I also do taxes. Which site did you use to become enrolled, and what testing from IRS.
I tried to find it on their web page but for some reason mine won't show the correct testing.

Thanks, Oh by the way I am still waiting on my check for the credit. I filed July 9th, sent in the additional info and the lady said another 16-20 weeks. Ridiculous to say the least.

Glad to hear Im not the Only One

I'm only a little into week 12 right now and have hard time understanding why in the world some of us first time homebuyers are having to wait past 16 weeks well over 100 days for IRS to process and amendment??? My question is has anyone spoke to one of the rep's for an update and spoke to the most rudest person that just got your blood boiling soo bad and makes you wonder how they get a job that most likely has great benefits and have the nastiest attitude??? Blows my mind. Young man here 25 years old just bought first home and just waiting to receive my check so can buy few things for new home. Thanks to everyone for providing all their feedback on this website so we know what each other is going through.

UpDate on my situation...

After 19 weeks and still no check I called the IRS again. (It is a weekly thing I do if I don't receive it by tuesday.) They informed me that my credit was actually finished being processed as of August 28th but that it had to go through another step so they could go over it one more time before sending out the check. They said you will have your check in 1-2 weeks.

I waited 2 weeks and nothing. I called back. Asked them what was going on. They said it shows here that your credit was approved but then they reversed it. I was shocked. I have never owned a home. The house I purchased was well over 80K and I owed no outstanding debts. They told me since I was past the 16 weeks that I would be assigned a tax advocate to look into it for me. They would call me within 5-7 business days since I was in a hardship situation. ( I don't have a refrigerator in my home, it broked down 2 weeks after moving in and I have 4 children.)

The tax advocate to my suprise called me within 3 days and said that the IRS accidently deleted my credit when it was being sent to be printed. HOW IN THE HECK DO YOU ACCIDENTLY DELETE SOMETHING? My tax advocate was great and she called them several times a day for a week and got it all fixed for us.

Now after 20 weeks we are finally given a mailing date of September 25th in the amount of $8,130.19. I will believe it when I see it. We shall see if it comes or not. That is if they don't delete it again before then...

My heart bleeds for everyone who has to wait past the 12-16 weeks...

Home buyers tax credit, I am still waiting too.

I live in Maine, St. Albans to be exact. I had my accountant prepare my forms to make sure it was done right. I than got them from my accountant, signed them double checked them and sealed them in an evelope for Kansas city. Well I brought it down to my local post office on August 10th and as of today, September 16th, The IRS still tells me there is no record of them receiving my forms... I am told they have so many and no system to check them in so they just sit there waiting to be processed and could take 12 to 16 weeks. I call now 3 times a week hoping to find something out but still get the same answer. I have duplicate forms ready to send just incase, but I am GOING TO WAIT FOR AT LEAST A FEW MORE WEEKS SO I DON'T CONFUSE THE IRS AND CAUSE THIS TOO TAKE LOONGER.

The number that I call on a weekly basis is 1-800-829-0922. Got 'em on speed dial. I'm to the point, now, where I just like to make them as miserable as I am. I've been waiting over 6 months, by the way.

A different story everytime

I called on Monday and was told I should have a check in the mail within 15 - 30 days. The lady said something about the date 9/5/09 to me on the phone. I forgot what she said so I called back. Of course you don't talk to the same person when you called the first time. We filed our 1040X form on 6/22/09. I was not aware of having to send the hud settlement papers. After 10 weeks of having my paper work, I was sent a letter requesting that paper. I faxed it in and they received it on 8/28/09. Just talking to this other person, they have 30 days to tell me they received my paper work. After that, they have up to 70 days to mail a check. If I knew this was going to cost me so much stress, I would have filed in 2010. I was wanting to put up a new fence for my dogs before winter. I would like to know if anyone else has had this letter sent and how long it was before the check was received.

Update on going to Congressman!! It Worked!!

I just wanted to update everyone. By going to my Congressman (see posting of Aug 26th) the Taxpayer advocate was brought in to my case.The advocate advised me that I would receive my check in less than 30 days. I received a call yesterday from my Congressman's staff person letting me know that I will receive my check with interest next week which is 3 days short of 30 days. Oh and she reminded me to claim the interest on next years tax return. I will still believe it when I see the actual check. But it seems to have worked.
