First Time Home Buyer Tax Credit

There has been a lot of talk (and confusion) about the economic stimulus bill and what it means to home buyers. Who qualifies? What year can I claim the credit? How much of a refund would I get back? What are the criteria to receive the credit? So I'm going to attempt to answer the most common questions about the bill. Keep in mind, I am NOT a tax professional or accountant and always recommend when it comes to your taxes to seek the advice of an accredited tax professional.

That being said, the bill states that first time home buyers can claim a tax credit worth $8,000 OR 10% of the home's value, whichever amount is less. So, if you bought a condominium for $65,000, your tax credit under the bill would be $6,500, not $8,000.

Qualifying

In order to qualify for the credit, the home purchase must be made between January 1st and November 30th of 2009 (so if you buy a home on December 1, 2009 you are not eligible). In addition, there are income restrictions as well. To qualify, a single person must make less than $75,000 a year. Married couples must make under $150,000 a year. However, higher income buyers may receive a partial credit. You must also live in the house purchased for at least three years or you will be required to pay back the credit. The property being purchased can not be owned by a close relative like a parent, grandparent or one of your children. The definition in bill for a first time home buyer is anyone that has not owned a home in the last three years.

Tax Filing

The credit can be claimed on your 2008 or 2009 income taxes. Now as I said you can claim the credit on your 2008 tax filing. If you have already filed them, you can file an amended return to claim the credit if you wish to do so. Based on the feeback we've been getting, the process takes about 12 weeks. Another great thing about the credit it that it is fully refundable, so even if your total tax bill (refund) is less than $8,000 (and you qualify for that amount of a credit), you would still receive the full $8,000 back plus the amount you had overpaid.

For example, John's taxes showed that he had paid $5,000 in taxes over the year. He filed his return and he actually only owed $3,000 in taxes. Normally he would have received a refund of $2,000. But under this bill, he would receive the full $10,000 instead! To claim the credit on your taxes is just a matter of filling out the form, without any additional paperwork involved.

STILL Waiting

I bought a condo back in October of 2009. I filed for my tax credit early October. I called once in December wondering the status, they said I should have it mid January. When I didn't receive it in January, I called again in February, they said they "MIGHT be reviewing it".. Finally in March I got something saying they needed more information. I sent them the information, it has been over a month and no word. I am on hold with the IRS right now trying to find the status. This is ridiculous.

I am in the same boat! I sent my taxes in on January 18th. Then it was processed and said to be released April 20th. However, we recieved a letter asking for more information (more signatures!). Now its been over 5 weeks since we sent the extra info and still no taxes! It is rediculous how long we have ti wait for this first time home buyers credit!

My husband and I bought our first house in July of 2009, we never owned a home before. We sent our taxes on March 11th 2010. It took about 3 or 4 weeks for anything to show up on the IRS website. It stated we should have our refund by May 11th We opted for Direct Deposit into out bank account. Its April 30th and nothing yet. I thought we would have received it by now, given there are no issues found. All the posts on this website from people who had no issues seem to have gotten their refund at least a couple weeks before the date given on the IRS website. We are 11 days away from our date. I just pray there are no problems found. My husband is Active duty Navy , we have never owned a home before or had financial problems. I'm just waiting for them to send a letter telling us we don't qualify because I drive a yellow car...... Or some stupid reason. I will post again when I hear anything from the IRS I will be crushed if we not get the money. I have good pans for it

Have you gotten your refund yet? We too signed up for direct deposit and were told that we should recieve our refund on May 11th. Just wondering if you had any news?

Update to my post I called the IRS 5/7 they told me on April 28th, they sent out a letter questing more information and you should get it any day now and to allow 4 weeks from he time they receive the information back to them. Its a load of crap because we sent in HUD and FTHBTC paper work but there is no use getting worked up about it because it wont change anything and I wont get my money any faster

how long do I wait before I start inquiring??

We mailed off our taxes the feb 15th and they recieved it certified 4 days later. I checked the status online and it says that we would recieve our money April 21, 2010, then May 1st, then May 22, now it says June 1st. Is this normal and when should I call to check on this to see what is the matter.

The same thing is happening to us!!! we got 4 date push backs from the website. Now we'll be receiveing a letter from them they say by 5/17/2010 for some 'additional information.' We maild it back in the middle of feb and have consistently checked and checked every 2 weeks by calling them....NOTHING! now they're sending us a letter to prove we've never owned a home before....HUH? We filed an ammended return on our 2008 taxes after closing on our house November 10th 2009. I think getting just in between the change from the old form that didn't require documentation and the new form that does definitely screwed us. I've been battling the same thing as everyone else - letters mailed to wrong addresses, different story every time you call.

Well, maybe IRS was listening. After repeatedly asking for a fax number so we could fax the documents we all know that they want instead of waiting for them to figure out our address, they finally told me one existed today!! The number they gave me to call to get this information that you are supposed to receive on your letter is:

Home tax credit

I purchased a trailer and land and closed on Feb 22, 2010. Can I wait and apply for my credit with my 2010 taxes? I do mine by Tax Act so I know I will need to go and do a paper file then for this. I have read so many things I am confused now. Thanks for any help.

I purchased my first home August 2009, it was a trailer. In Texas you do not get a HUD statement for a trailer. I overnighted my tax return with my first time home buyers credit (for 2009 tax year) one 1/21 IRS received it 1/22. I filed together, did not do an amendment. End of February I got my regular tax return but no first time home buyers credit. I checked the website and it said the IRS needed more information. I got a letter in the mail about a week or so later and it said the IRS needed no more additional information. About 3 weeks letter I get a package asking for additional information. I called the IRS and explained to them I didn't get a HUD statement due to my home being a trailer and we went over forms the IRS needed. I did included a statement from the state department of housing mobile home division stating that I purchased the trailer, showed the address of the trailer and the lien holder and faxed it 3/23 (they gave me no problems when I asked for the fax number). 4/5 I get a letter acknowledging they received the fax and it'll be 30 days. 5/3 I called in to check status to only be told they haven't even LOOKED at my paperwork I faxed 3/23. I was told that they were busy and it was first come first served (even though I filed 1/22). Then I get a letter dated 5/3 saying it'll be another 30 days. I'll either get my tax return or yet another letter (which I'll probably get the letter). I have a co-worker that filed his tax return w/o credit, then did an amendment in April and was told he's getting his this Friday. I'm waiting to see if he does get it, if he does I'm calling again. The IRS is being very inconsistent. I've never been audited, my tax returns have been straight up, nothing unusual or weird and I always do direct deposit.

You just as well file an amended return for this year. It seems like you will be lucky to even get it by next year. I filled mine out Jan 23. I had them professionally done. I met all requirements. Today they said mine is denied. I am very pissed. This is ridiculous. The operators at the IRS are pleasant but the system is failing many people who need the money. I wish the government would stop sending people money that havent earned it and start paying back the people who earned it.

First Time Home Owner

I have lost count of how many times I have spoken to the IRS and my advocate.Its in the review department , You might be missing information, Did you get a letter?
NO NOTHING AT ALL NOT ONE SINGLE LETTER IN ALL THIS TIME.
I called the advocate 2 weeks ago and was told that after providing all the information they had requested I would have the credit last friday and that she would call me when the funds were released. 2 wees went by no phone call.
I called her and it's now on the shelf! What the heck is that? I asked.

Extra review?

The IRS just reported to me that while I did submit by 2009 taxes in January, and while they did receive the additional signatures needed on 3/15, they still couldn't release my credit, but are finally releasing part of my refund (non-homeowner credit related). The IRS then reported that I am scheduled to receive a packet of information regarding my credit in mid-May and from there they forecast releasing my credit after 45-days at the earlierst. They mentioned that I may still be sent into an advanced review process, which would delay me even further. Has anyone else been told this?

Yes I have been having the same problem... I summited my amended return in November 2009 and here it is May 7th 2010 and i am still waiting!.... I have been getting a different story for months... wait for this wait for that etc.

We filed our 2009 tax return on Feb. 4 and about a month later the IRS website said we should expect our refund April 20. We included our HUD settlement with our paperwork. Then on April 13 we received a letter saying they needed a copy of out settlement statement. I called to see why they didn't have it and all the lady could tell me was to send it if the letter said to. Now the website has no expected date of our return and when we call they say wait another 6-8 weeks and call back. That's the nice ones...I had one lady tell me "Honey everyone in the world are sending their taxes to us, we are so busy just call back in another month or so" without even taking my information or looking up our file! I'd like to know how they originally expected to send our refund on the 20th if they didn't even realize they needed another paper until arounf the 13th! I think they needed more time and just said they never got the settlement statement!

My son is going thru this nightmare also. I am sure we will find out he has to send in papers showing his mortgage etc and I am surprised that was not requested when he filed, altho I have seen some people say that Turbo Tax informed them of this , Tax Act did not............
Good luck to everyone. He sent his forms in on Feb 2, 2010 these were lost so we sent them in again March 22 certified and they just showed up as received today, April 27th.
I think it is very rude of some to think people are being ridiculous to want their credit in the manner it was presented to them. I am sure if the government had said it will take up to a year for you to receive your credit then noone would be complaining but when you expect your credit within 6-12 weeks then the frustration is understandable.

Tax Advocate

I tried this and guess what? There are no tax advocates assigned for the home buyer credit. There are no advocates being assigned to anyone with home buyer tax credit issues, so it is no longer an option. I have spoken to so many people and not one of them has been nice or provided any information. Sweet huh? Aren't you glad you bought a house now? It's like a savings account you can't touch if you need it or not.

With the billions of dollars they take in, why can't they hire some help there and give the American People jobs, I'm just waiting for some outsourced company to begin taking the calls.

We filed our taxes on Feb 1, 2010 it's May 5 and still it says under review. This is frustrating considering the online info told us we would have our refund by April 13. We have been patient enough.

We mailed our FTHBC at the end of jan with our reg. 2009 tax return and we are still waiting with no end in site.We got a letter three weeks ago saying to send in our CS agian, faxed that the same day.When I call they say they cant even tell me if they got the fax intil 4 weeks. On the wheres my refund web site they say I sould get my refund tomorrow that is if they dont need anything but I think that letter pushed back my date and they have not updated there system. I would just like to get a date a real date.

Call IRS on the 4/5/10, was told my credit was allowed and to called back in 2 weeks for a release date of the funds;

Check was mailed on 4/23/10;
Received my check today on 4/26/10.

That's to sum it all up in a nut shell ( the short version)

I won't detail the long version of what exactly I had to go through because I went through just about everything that everyone has gone through. Plus by the time I get through, it will be a 100 page book! The phone calls, the run arounds, dates changing, told to wait this long, that long, submitting documents after documents, it was really a horror movie.

But I stuck through it, I didn't have to get a tax advocate involved, I just fought it myself. I had to remind myself because of my situation, that it was my faith in God that got me into house which took 6months to closed on, and it will be by faith that I would get check. It couldn't came at a better time. God knew exactly what he was doing, because if I gotten the money any earlier...yeah you already know.

So people please I know your frustrations, I can honestly relate to many of you and what you are going through because I went through the same thing. This is simply to give hope to some and inspiration to others, just stick with it, DO NOT GIVE UP (that's not an option), reply back to everything they send and you will eventually see the results. There is a sliver lining around every dark cloud, the sun will shine after every storm, you just have to endured and weathered the storm. "Trust in the LORD in all thy ways and lean not to own understanding" He is in control.

I will leave you with this, some words of widsom my father gave to me, GOD never sleeps nor slumber, there's no need for the both of us staying up worry about the problems. GOD said cast your burdens at cross and be at peace.

Don't lose any sleep nor worry about it, put it GOD hands, have faith and EXPECT TO RECEIVED YOUR BLESSINGS!!

My husband and I are in the middle of a nightmare. The IRS said that they denied our claim for the $8,000 because we paid mortgage interest in 2006. Neither one of us have ever owned anything other than a car. How do we prove that to the IRS so we can get our money?

Sort of like this person said..just hang in there. I'm waiting too and have already made vacation plans for Memorial day weekend. I'm still hopeful that I will receive the money by then, but if I dont I will just have to delay the vacation. Like many others I have no idea when I'll get my money. My best advice is to just hang in there, and DONT call the IRS and bug them. I know it's painful waiting for something this big, but other people have said that they have received their money, so we will all get it..eventually..but just like everything else in life dont count your eggs before they hatch!!

I would like to say that your words were some I need to read, I have been going back and forth on my tax return since Feb. 2010 and I still can't get a straight answer, I'm looking for the repeat homebuyer credit, I lost my home to a fire and waiting on this money to put furniture in my new home, right now we are sleeping on the floor, but I want to say thank you for the words of inspiration.

Refund Being "Reviewed"

My boyfriend and I bought a house in May 2009. Waiting until we did our 2009 taxes to claim the 8K credit on his tax retrun. I am an accountant and did all of our taxes using Turbo Tax so of course, he has no idea what he claimed, how much, or even his status as I take care of all that. So they refuse to talk to me on the phone and i conference him in and he tells them its ok to speak with me but they still won't and he gets flustered answering all the q's !!! But that's another story !

We mailed in his return certified mail on March 1. The IRS didnt show it received utnil 4/5/10. We then see on the refund status online that we should receive it on 5/4. I was a bit skeptical but still hopeful. On 4/19 that date was changed to 5/18/10. I kept telling BF there was no way we would even recieve it in May. Then on 4/26 I logged on to check again and it now states that add'l info is necessary. We signed the return, sent a signed HUD1 stmt, and sent a mortgage stmt in with our return so i have no idea what it is they could be requesting. Neither of us have ever owned a home and we are both listed on the mortgage/deed. We called the IRS and after 1 hr they were able to tell us that he should receive his regular refund on 4/30 (we'll see about that) and that no letter has been generated or sent yet, but we can expect on in 2-4 weeks but no one knows what it will ask for. The IRS claims it doesnt know what it is requesting ????

I have a bad feeling about all this!!! You would think after months of doing these first time home buyer credits that there would be a better system in place ? I hope to get my letter very soon and from others comment on here I will contact a tax advocate at that time (though i hear that i have to wait 180 days to contact an advocate) and also write my congress people. Within 30 mins of my house the IRS has 2 local offices....I am wondering why couldn't they set it up so that for something like this I could take the required paperwork and form to one of those office and work through them ??? Seems it would be a better system. The people on the phone (took 3 people to get to someone) were very RUDE. I am not really surprised with this whole thing but it is disheartening to deal with all of this when you would like the money.

Its supposed to be a stimulus to the economny but its not stimulating much if folks don't get their money for 9 months !!!

I did it myself, amended my 2009 tax return on January 20th with the 5405, 1040x, and my HUD Closing Statement, received $8,000 + $318 interest!! Thank you Government!

I send my 2008 amended tax form in Nov 2009, I have been waiting for a reply and finally on April 19, 2010 I got my 1st reply. They want more information closing documents, a copy of a check cashed by the mortgage company, and address change information 4 options given copy of ID or DL with new address, bank statement, vehicle registration, or/and utility bill in the name of the new owner. I spoke to the IRS rep @ 800-829-0582 she said the more proof you send that you live at the property the better and faster it would be for them to reply back to you, but now i got to wait some more. good luck to me

I filed my tax return in

I filed my tax return in Jan 2010 with the home buyer credit because of the extension given. I forgot to mail my HUD statement with the return but was mailed 4 days later. After six weeks I receive 2 letters from the IRS requesting the additional paper and letter saying that have receive it. In the second letter it was stated it would take additional 45 days to process. I am trying to understand why it taking so long to process paperwork. I live in Texas and mailed my return to Austin office. The personnel in the Austin Office should be able to process our return in a more timely manner. Even assigning personnel certain letter group should cut down of the processing time. If filing your return e-file has the same information as mailing it in what is on the e-file that is making the process quicker. Also if the return in mailed in on the return it asked it you want to have your refunded direct deposit in your account why is the IRS mailing the refunds when the request on the person return to have it deposit. It really amazing if you owe the IRS money that process will take less than 2 weeks to get done. I know the IRS in the government and the government is not perftect but they need to have a better way to process their returns. You can bet that no one in the IRS waited the amount of time for their paperwork to go through.

Frustrated

I am shocked to see how many are getting the "you didn't sign your return" letters from the IRS. I bought a condo in January 2010 and claimed the FTHBC on my 2009 return, which I filed the end of January 2010. At one point, the IRS web site said I would be getting my refund by April 6th. After that, I got the infamous "you didn't sign your return" letter. Tried to fax it over several days but couldn't because the fax number at IRS wouldn't answer the phone. Gave up finally and mailed it. I called the IRS to ask about how this would impact my refund date (it is supposed to be direct deposit) and was told it would delay about 2 weeks. Web site now says they received my return and are processing it with no promised refund date. I called IRS again today and was told they don't show they ever got my paperwork they requested. Was told to wait 7 days and then call back to find out the status (she said hopefully the system would be updated by then). She said the department that sent me the letter should send out another letter if time passes and they don't hear from me. So my options after 7 days, if they still don't show they received it, I can take time off work and hand deliver a new return to the local IRS office, mail it (ha!), or if I have received the new set of paperwork to sign, mail that. Doesn't look good. I think frankly that the IRS had these "you didn't sign your return" letters all ready to go to delay things. I'm seeing some say they got interest! What?! Since when does IRS give us interest?

Tax Refund

I mailed my amended return for my tax credit on MArch 3, 2010. I called two weeks later and they told me it was not in the system as of yet. I called a month later and they told me it was put in the system and its in review. I called this morning and they said there was a note saying that my check will be mailed out on April 23, 2010. She said "I guess you are one of the lucky ones!"

I was wondering if you happen to know what to do about this..... I already filed my 2009 taxes and just bought a home April 30th of 2010. Do I need to ammend my 2009 taxes or can I just send the 5405 form in with my HUD papers?

I need my money

Here is my story... I closed Oct 30 and waited until March to do my taxes. I included the 5045 with my 2009 taxes and sent in my HUD1 and a copy of my deed. It was in the system 4/10 with a date of 5/11 if everything was ok. I checked today and it now says 5/25. I hope this process does not take forever. I hired a contractor to do some work. He removed everything from the house, got a check for $14,000 and stop doing work on my house. He will not return any money.....so I really need my money.

Week 29 Waiting - Check is in the Mail - What Worked for Us

We filed our amended form for our credit in Oct. 09. We dealt with many of the same complaints (lost forms, denials, confusing and inaccurate information from the IRS, long hours on the phone, etc., etc.) listed throughout this blog. We enlisted the help of a Tax Advocate and we wrote our senator and representative. Don't know if writing them did anything but our Tax Advocate really seemed to help. She was unfront, knowledgable, and delivered on all the dates and information she promised. She called last night to say our check will be released on April 30 with $330 interest. I believe her as she has delivered every time so far.

I think the most frustrating thing about the whole process was not being able to get reliable information from the IRS. If they had told me upfront it would be 7 months to get the refund, I could have lived with that. Unfortunately, it was the constant misinformation that was so awful.

10 months and counting

We bought our house in June 2009 and filed an amended return the same month. I have made phone calls and have five different letters telling me they will get back to me in 30 days. Another 30 days passes and I get another letter saying they will get back to me in 30 days. ughhh I am so frustrated. I already have my '09 taxes back! I should have just waited to file it with them.

I agree with someone who said that if they were just upfront and said it would take this long, I could accept it, but instead they keep shoving me off each month leaving me in the dark. I need to get in touch with a tax advocate it looks like.

I closed Aug 12 sent my amended return the next day. Contact your local Congressman. I kept getting the run around from the IRS so I called our congressman. It's been about 3 weeks and he has got my credit approved and my check will be in the mail in 6 weeks. He really sped the process up or I would probably still be waiting for a response. Good luck!

Our story is almost

Our story is almost identical to yours. IRS received our ammended return on Oct.16th, after many calls to the IRS we were'nt getting anywhere. So finally in late March we asked for and got an advocate. She was very prompt and professional, we sent her the documents she asked for within 3 days of the request and after about a week we recieved a call from a tax agent, answered a few more questions over the phone and she said the credit would be approved. 3 days later our advocate said our cedit would be mailed on April 30th with $331 in interest. Hopefully, we will receive it during the 1st week of May.

If you can get an advocate, that's the way to go. Otherwise your probably just going to get the runaround.

Dont know how to solve this

Our story is starting to become a nightmare. Filed our taxes 2 months ago and we just received a letter saying our return for the first time home buyer credit was denied because we are not first time home buyers. CRAZY...we have never purchased a house in our lives. Called the phone number provided and they said there is no way they can explain what is going on or why our request was denied. Is getting an advocate the best solution for this? Do they charge?

16 weeks

I started this process in Dec of 09 not knowing that the credit was going to be extended and if I would have waited and filed with my 2009 taxes I would have gotten the refund within 30 days. they held my ppw until they started receiveing them again in Feb. I know there was lots of fraud prevouisly on those checks that were going out within 4 weeks and we had to suffer the concequences. With that being said my ppw was rec on 2/16 and went into process right away which was shocking. I recevied a notice on 3/26 stating they needing an additional 30 to 45 days to process. I called yesterday 4/22 and was told my check will be released on 4/23 with $324.xx intrest. Hang in there this was a loooong process BUT it is free money! :O)

I closede on my home march 5,2010. I had my tax papers amended and researched the correct location to send them. I am in Ga so had to send to atlanta location. On March 11 I sent papers certified mail. Last week kI called and they said my papers were already processed and in the system between the 18th and 23rd. I was told to call back On the 26 to get expected date of how long it will take to recieve check in the mail. The representative was shocked to see it processed so fast... tips find out what location you need to mail your amended papers too then send it certified 't making sure it don't get mixed in with thousands of others. also have all forms needed please extra copies of hud 1 title and any other forms showing proof of ownership. If you send all the forms the first time then your papers should be processed a lil faster.

Bought our house in June

Bought our house in June 2009, filed on 2008 taxes in October (we got an extension) denied! They asked for more information, we sent it. Still denied! Took three weeks to find someone on the phone to tell me why???? They said my husband was a "mortgage holder" Well, he is not and hasn't been since 2004, sent in the proof, all they will tell me now is they have the information and it hasn't been reviewed. I bet I never see it, and yes we meet every qualification. How do I get an advocate?

I need my money

Here is my story... I closed Oct 30 and waited until March to do my taxes. I included the 5045 with my 2009 taxes and sent in my HUD1 and a copy of my deed. It was in the system 4/10 with a date of 5/11 if everything was ok. I checked today and it now says 5/25. I hope this process does not take forever. I hired a contractor to do some work. He removed everything from the house, got a check for $14,000 and stop doing work on my house. He will not return any money. The only way I will be able to get money from Nikel Contracting is to take them to court.....so I really need my money.

Unreal

I sent my return in by certified mail at the end of January and toward the middle of March I recieved a date of March 30th when I should receive my refund. The IRS website Wheres my refund status changed after March 30th had arrived and provided me with a phone number to contact rearding the return. I contacted the rep and he stated that he did not see a problem with the return however he needed to refer it to a different department. He stated I should receive a letter in the mail in the next two weeks stating what the problem with the return is and if further documents are needed. Three weeks have passed and no letter!! A second call to the IRS and this rep stated they have not received my return! WHAT??? A third call to the IRS and the rep stated the referal was sent but was not addressed and the return would be sent back to processing after a month. So low and behold I still do not know what the problem with the return is and now the cycle is going to start all over again. Another 4 to 6 weeks. I understand that the representatives have a difficult job dealing with complaints but to be given complete wrong information in unacceptable. The rep finally stated that it would do me no good to complain. That's just great.....( ACCOUNTABILITY)!!!!!!!!
